2. Nature of Professional Representation

The Online Tax acts as a facilitator and authorized representative (through its Chartered Accountants, Tax Advocates, and Company Secretaries) to assist you with tax filings, corporate registrations, and legal appeals. However, you acknowledge that:

  • We provide professional advice based on current Indian laws (including the Income Tax Act 2025 and CGST Act), but we do not guarantee specific outcomes, approvals, or favorable judgments from government authorities.
  • The final authority to grant licenses (e.g., FSSAI, Trade License, Trademark) or pass assessment orders rests exclusively with the respective government departments.

3. Client Responsibilities & Data Accuracy

As the taxpayer or business owner, the ultimate legal responsibility for the accuracy of your financial filings lies with you. By using our services, you agree to:

  • Provide 100% accurate, complete, and truthful information regarding your income, expenses, assets, and liabilities.
  • Supply required documents, digital signatures (DSC), and OTPs (One Time Passwords) in a timely manner. Delays in providing these may result in missed statutory deadlines, for which The Online Tax shall not be held liable.
  • Not conceal any material facts, offshore bank accounts, or crypto-assets that are mandated to be declared under Indian law.

4. Limitation of Liability

To the maximum extent permitted by law, The Online Tax, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services. Specifically, we are not liable for:

  • Government Portal Downtime: Missed deadlines or late fees caused by the crashing, maintenance, or malfunctioning of government portals (MCA21, Income Tax e-Filing, GSTN, FoSCoS).
  • Penalties & Interest: Any statutory interest, damages, or penalties levied by government authorities due to discrepancies in the raw data provided by you, or due to your failure to pay your self-assessed tax liabilities on time.
  • Application Rejections: Rejection of trademarks, company names, or licenses by government officers due to non-availability, objections, or changing departmental policies.

5. Payment, Pricing, and Billing

All prices listed on our platform are exclusive of applicable GST unless stated otherwise. Our professional fees do not cover out-of-pocket expenses, statutory government fees, stamp duties, or vendor challans, which must be borne by the client. For rules regarding cancellations and reimbursements, please refer strictly to our Refund Policy.

6. Indemnification

You agree to indemnify, defend, and hold harmless The Online Tax and its professionals from any claims, losses, damages, liabilities, audit notices, or legal actions brought by third parties or government authorities arising from your fraudulent data, tax evasion, breach of these Terms, or violation of any Indian law.

7. Force Majeure

The Online Tax shall not be considered in breach of its obligations or liable for delays in service execution caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, government lockdowns, or sudden statutory changes in tax laws.

8. Intellectual Property Rights

All content, graphics, text, logo, and legal drafts published on this website are the intellectual property of The Online Tax. You may not copy, reproduce, or distribute our proprietary content without explicit written permission. However, the specific legal documents, returns, and licenses generated for your business become your exclusive property upon full payment of our fees.

9. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms, or the services provided, shall be subject to the exclusive jurisdiction of the competent courts located in Lucknow, Uttar Pradesh.
